The interrelationship between the Americans with Disabilities Act (ADA) as amended, the Family and Medical Leave Act (FMLA) and Worker’s Compensation is confusing: How do you know which law(s)you are dealing with? Can an employee’s request for leave be covered by more than one law? When can you re-quest additional information or a second opinion? There are a few considerations depending on the type of injury, how the employee became injured and their job status at the time. We will discuss how changes in the interpretation of the law have altered how leave must be calculated and given.
